PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to transfer the Investigation in Crime No.178 of 2023 on the file of the 4th Respondent/ Manamadurai Police Station to CBCID or any other independent investigation agencies within the time stipulated by this Court.

ORDER

This Criminal Original Petition has been filed seeking transfer of investigation on the ground that over the alleged occurrence or suicide, repreated representations have been made by the petitioner to various authorities, but those things were not properly enquired.

2. The learned counsel for the petitioner would submit that because of the averment made by the accused persons, the petitioner's husband committed suicide. Inspite of that the First Information Report has been registered in Crime No.178 of 2023 under section 306 of IPC, but no steps have been taken either to arrest the accused or to complete the process of investigation.

3. The Officer from the second respondent's office is present before this Court and stated that all the accused persons have granted Anticipatory Bail either by Principal Sessions Judge or by this Court.

4. The learned counsel for the petitioner would further submit that after filing of this petition, the above said accused persons have been moved anticipatory bail applications and obtained order. Further he would submit that the investigation process may be supervised by the third repsondent herein.

5. Considering the fact that both the complainant and the accused persons belong to the very same department, the above said investigation process shall be undertaken by the fourth respondent under the direct supervision of the third respondent herein and complete the same within a period three months from the date of receipt of copy of this order. 3/6

6. With the above said direction, this Criminal Original Petition stands disposed of.
