ORDER

As the petitioners had not enclosed the necessary forms as required by the Code of Civil Procedure, the learned trial Judge has not numbered the application. Hence this revision.

2.O.S.No.171 of 2024 is a suit seeking the following reliefs: i)Declare that the registered settlement deed dated 20.05.2024 executed by the first defendant in favour of the second defendant pertaining to the suit property, registered before Sub Registrar Office, Vilangudi, as document No. 2414/2024 is liable to be set aside as void and illegal. ii)Permanent injunction restraining the first and second defendants from operating the partnership concern "S.R.L.Fabrics Firms" account (current account No. 650014110000) of third defendant bank.

iii)For costs of suit to be paid by the defendants to plaintiffs.

3.Along with the plaint, the plaintiffs had enclosed two documents, namely, the partnership agreement between the plaintiffs and the defendants dated 01.06.2004 and another partnership agreement dated 01.04.2011 between both the same parties. What had been produced is only a photostat copy before the trial Court. Hence, the defendants took out an 2/4

application calling upon the plaintiffs to produce the original of the aforesaid partnership deeds. Mr.Sundar represents that the learned trial Judge has not taken the application on file on account of the fact that the plaintiffs have not enclosed the necessary forms. This is the procedural aspect which could have been complied at the trial Court level itself. 4.Be that as it may, as Mr.Sundar is willing to enclose the necessary forms along with the application, I am inclined to direct the learned trial Judge to number the application, after being satisfied that it is accompanied by the necessary form. This Civil Revision Petition is disposed of accordingly. No costs.
