ORDER:- This Civil Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.M.P.SENTHIL, Advocate for the Petitioner and of MR. A.ARUMUGAM Advocate FOR R2 and of Mr.R.RAJESH KUMAR Advocate FOR R3 AND R4, and this Court made the following order:
This petition is filed under Order 41 Rule 19 and Section 151 of CPC, to restore the Second Appeal in S.A.No.832 of 2004, which was dismissed on 12.10.2006.
2.No appearance on behalf of the respondents 3 and 4. The learned counsel appearing for the second respondent did not raise any serious objections.
3.This Court is also satisfied with the reasons assigned in paragraph Nos.3 & 4 of the affidavit filed in support of the petition.
