Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents 1 to 4 herein from taking over of the petitioner's property and hand over the same to the 'Pedestrians' Association' and further direct the second respondent to measure the petitioner's property in Survey No.935/1B9 situated at Ayyalur Village, Vedasandur Taluk, Dindigul District, based on his representation dated 02.05.2023.

This Writ Petition has been filed seeking to forbear the respondent Nos.1 to 4 herein from taking over of the petitioner's property and hand over the same to the Pedestrians' Association and further direct the second respondent to measure the petitioner's property in Survey No.935/1B9 situated at Ayyalur Village, Vedasandur Taluk, Dindigul District based on his representation dated 02.05.2023. 2/5

It is the case of the petitioner that the petitioner is the owner of the property and that the third respondent / Executive Officer is attempting to hand over the petitioner's patta land to the Pedestrains' Association. Aggrieved over the same, the petitioner submitted a representation to the respondents on 02.05.2023. Since the said representation has not been considered till date, the petitioner has approached this Court.
3. The learned Government Advocate appearing for respondent Nos.1, 2 and 4 would submit that the representation of the petitioner dated 02.05.2023 would be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the respondents to consider the representation of the petitioner dated 02.05.2023 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. 3/5
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
