Pleased to call for the entire records connected with the judgment rendered the Hon'ble Additional District and Sessions Judge, Virudhunagar in S.C.No. 62 of 2018 dated 13.09.2022 and set aside the same and consequently acquit the appellant. Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.PRAKASH.R, Advocate for the petitioner and of Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This miscellaneous is to modify the condition imposed by this Court vide order dated 25.08.2023 in Crl.M.P.(MD) No.6414 of 2023 in Crl.A.(MD) No.328 of 2023 and to permit the petitioner to produce a normal surety before the learned Additional District and Sessions Judge, Viruchunagar, instead of a blood relative surety.

2. In view of the submission made by the learned Additional Public Prosecutor for the respondent - Police that the petitioner is having four previous cases, we are not inclined to modify the conditions already imposed by this Court.
