For Petitioner : Mr.R.Mayilsamy (party in person) For Respondent(s): Mr.S.Vinodh, Government Advocate Prayer: Writ Petition filed under Article 227 of the Constitution of India to issue a Writ of Mandamus directing the 2nd to 5th respondents to remove the encroachment of water body at Vilangudi Big Tank in Survey No.2/1 for an extent of 127 Acres in which 20 Acres and 12 Canals are encroachment in Semparthi Nagar Street Nos.1 to 3, Ayyappan Street, Ganapathi Nagar and Sakthi Nagar situated at Ward No.23, Pudhuvilangudi - II Bit, Madurai North Taluk in Madurai District.

ORDER

Heard both sides.

2.The petitioner's primary grievance is that channels leading to Vilangudi Big Tank in Survey No.2/1 have been encroached. This writ petition was filed in the year 2021. We fail to understand as to why the official respondents have not till date conducted any survey. 3.We direct the official respondents 4 and 5 to issue notice to all the interested parties and encroachers before conducting survey. If the survey results indicate that there are encroachments in the water body, the same shall be removed. All the encroachments shall be cleared within a period of four months from the date of receipt of a copy of this order.
