Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to issue Police Clearance Certificate (PCC) to the petitioner's passport in Passport No.T0711362, by disposing the petitioner's Application in S6052500147677 dated 23.04.2025, within the stipulated time fixed by this court.

ORDER

This writ petition has been filed for a writ of Mandamus directing the respondents to issue Police Clearance Certificate (PCC) to the petitioner's passport in Passport No.T0711362, by disposing the petitioner's Application in S6052500147677 dated 23.04.2025.

2.It appears that the complaint has been filed against the petitioner and FIR has been registered in Crime No.221/2020 on the file of the second respondent Police Station. However, no charge sheet has been framed against the petitioner till date. The petitioner seeks for issuance of Police Clearance Certificate pursuant to the application filed on 23.04.2025. However, the same has not been processed in the absence of Police Clearance Certificate. 3.Already, this Court has taken a stand that mere filing of FIR cannot be an impediment for processing the petitioner's application for passport. Be that as it may, there shall be a direction to the second respondent to issue necessary Police Clearance Certificate to facilitate the petitioner to process 2/4

the application in accordance with law, in terms of the decision in Subramaniyan Vs The Regional Passport Officer and others in W.P(MD)No.30110 of 2023. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. 4.The writ petition is disposed of with the above direction.
