O R D E R

This writ petition has been filed seeking a writ of Mandamus to direct the first respondent to take necessary departmental action against the third respondent for dereliction of her official duty in pursuance of petitioners representation dated 25.02.2022.

2. When this Court expressed that for the non-compliance of the order, dated 06.08.2021 passed in Crl.O.P.(MD) No.1081 of 2021, the remedy available to the petitioner is to file a petition for contempt. However, without resorting to filing of contempt petition, the present petition is filed seeking departmental action against the third respondent for dereliction of her official duty. The filing of this writ petition in the 2/5

considered view of this Court is nothing but an abuse of process of law. When this Court is about to dismiss this writ petition, at that point of time, learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition. Considering his request, permission is granted.

3.Accordingly, this writ petition is dismissed as withdrawn. No costs.
