O R D E R
The present Transfer Civil Miscellaneous Petition is filed to withdraw H.M.O.P.No.48 of 2019 from the file of Family Court, Chengalpattu and transfer the same to the file of Family Court, Dindigul.
2.The learned counsel for the petitioner/wife submits that the respondent/husband has filed H.M.O.P.No. 48 of 2019 before the Family Court, Chegalpattu for dissolution of marriage. It is further submitted that the petitioner is living with her aged parents at Dindigul and she has no source of income. The distance between Dindigul and Chegalpattu is about 400 kms and she could not able to spend money for her travel. In such circumstances, it is difficult for the petitioner to travel from Dindigul to Chegalpattu for attending every hearing in H.M.O.P.No.48 of 2019 on the file of the Family Court, Chegalpattu. Hence, he seeks to transfer the case.
3. The learned counsel for the respondent has not appeared today.
4. This Court is satisfied with the reasons stated in the affidavit filed in support of this petition.
5. Considering the facts and circumstances of the case and also considering the submissions made by learned counsel for the petitioner, H.M.O.P.No.48 of 2019 is withdrawn from the file of the Family Court, Chengalpattu and transferred to the file of the Family Court, Dindigul, for disposal as per law. Tr CMP (MD) No. 268 of 2019 Chegalpattu is directed to transmit the papers to the Family Court, Dindigul, forthwith. The Judge, Family Court, Dindigul is directed to dispose H.M.O.P.No.48 of 2019 on merits and in accordance with law, as expeditiously as possible.
6. In fine, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
