For Respondent : Ms.Anantha Devi, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.439(1)b of Cr.P.C PRAYER :- To modify the condition imposed upon the petitioner in Crl.OP (MD)No.22840 of 2018 dated 05.02.2019 on the file of this Honourable Court.

ORDER : The Court Made the following order :- This petition has been filed to modify the condition imposed on the petitioner in CRL OP(MD) No.22840 of 2018 with regard to the directions issued by the Court that the petitioner shall deposit a sum of Rs.4,60,000/-.

2. This Court while granting anticipatory bail to the petitioner in para(3) it has been stated that on instructions the learned counsel for the petitioner h as submitted that without prejudice to his right the petitioner is ready to deposit a sum of Rs.4,60,000/- to the credit of the crime number and the same may be disbursed to the defacto complainant.

3. Taking into consideration the aforesaid submissions,this Court has granted anticipatory bail to the petitioner directing the petitioner to deposit a sum of Rs.4,60,000/-. Therefore ,it would not be proper on the part of the petitioner to go against his undertaking. Further, modifying the said order would amount to review the order and the same is not permissible under law.

4. Hence this petition is dismissed.
