O R D E R

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the respondents to expedite the investigation and take appropriate action in Crime No.96 of 2020 and the petitioner's complaint dated 26.06.2022 by considering the petitioner's representations dated 22.09.2021 and 26.06.2022.

2. The facts of the case are that the petitioner purchased the car through loan from the HDFC Bank, Alangudi Branch, Pudukkottai District. Thereafter, due to financial situation, the petitioner sold his car to one Durai and his son namely, Saravanan. The said persons paid only Rs.50,000/- to the petitioner and they promised to pay the remaining amount for the car loan received by the petitioner. When the Bank officials approached the petitioner for loan dues, the petitioner came to know that the said persons failed to pay the car loan. Thus, they paid 2/5

only 7 installments. Aggrieved over the same, the petitioner lodged a complaint before the third respondent and an F.I.R was also registered in Crime No.96 of 2020 dated 01.03.2020 for offences under Sections 420 and 506(i) I.P.C. Again on 26.06.2022, another complaint was preferred by the petitioner. But no action was taken by the respondent Police to investigate the case. Having no other way, I preferred a representations dated 22.09.2021 and 26.06.2022 to the respondent Police to expedite the investigation. Since no action was taken, the present Writ Petition has been filed.

The learned Government Advocate (criminal side) appearing for the respondent police submitted that the case has been registered in Crime No.96 of 2022 and he further submits that the respondents have received the representation of the petitioner and they are ready to consider the petitioner's representation.

4. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (criminal side) appearing for the respondent police. 3/5

5. Recording the submissions, this Court directs the third respondent to complete the investigation within a period of four (4) weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No cost.
