O R D E R
Challenging the transfer order dated 22.05.2025, passed by the first respondent, the present writ petition has been filed by the petitioner.

Earlier, this Court, on 18.08.2025, had passed the following order: "The learned counsel appearing for the petitioner would submit that the impugned order has been passed not on the administrative exigency, but on the basis of the complaints made by the teachers and professors as if the petitioner demanded bribe for grant of incentive increment. However, without taking any disciplinary action against the petitioner, transferring the petitioner from one place to another place, ie., from Melur, Madurai to 2/5
Vedachandur, Dindigul, vide the impugned order is not sustainable.
2. The learned Additional Advocate General appearing for the respondents 1 and 2 fairly concedes that in the absence of any administrative exigency, no one can be transferred. However, he will get instructions with regard to the disciplinary proceedings initiated against the petitioner."

Pursuant to the aforesaid order, today when the matter was taken up for hearing, the learned Additional Advocate General appearing on behalf of the respondents would submit that the present writ petition has been filed by the petitioner challenging the transfer order on the ground that it was vindictive as it was issued alongside the initiation of disciplinary proceedings and without any administrative exigency, which is not sustainable. Subsequently, the respondent Government realized that the conduct of the petitioner warrants disciplinary action. Accordingly, the learned Additional Advocate General accepts to withdraw the transfer order and seeks permission from this Court to initiate disciplinary proceedings against the petitioner in the manner known to law. Such proceedings will be conducted and concluded as per the Disciplinary Appeal Rules.

Recording the said submission, the impugned transfer order dated 22.05.2025 is hereby withdrawn and the present writ petition is closed granting liberty to the respondents to initiate disciplinary proceedings against the petitioner or to pursue any other legal proceedings, if so advised.
