O R D E R

This Writ Petition has been filed seeking a direction to the respondents to ensure and protect the members of Ulavar Santhai, Palani and further direct the respondents to prevent unauthorized selling the vegetables from 06.00 am to 10.00 am in front of the Ulavar Santhai, Palani, whose non member of Ulavar Santhai based on the petitioner's representation dated 05.05.2023 and communication of the first respondent dated 18.05.2023 within the period stipulated by this Court.

It is the case of the petitioner that the wholesale vegetable sellers have shifted their shops in front of the Ulavar Santhai, Palani, without obtaining any permission from the second respondent and are selling vegetables there. Therefore, the members of the Ulavar Santhai submitted a representation to the first respondent on 05.05.2023 seeking eviction of the unauthorized sellers operating in front of the Ulavar Santhai, Palani. After receipt of the said representation, the first respondent sent a communication to the second respondent on 18.05.2023 to take necessary action for the above said issue. Since the petitioner's request has not been considered till date, he has approached this Court.

3. The learned Government Advocate appearing for the first respondent would submit that the request of the petitioner would be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the second respondent to consider the request of the petitioner by taking into account the communication of the first respondent dated 18.05.2023 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
