ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the refusal check slip dated 21.05.2025 and consequently, to direct the respondents to register the sale deed dated 21.05.2025.

2. The contention of the petitioner is that the respondents have rejected the sale deed since the punja land has been divided into plots, and the petitioner is purchasing one of the housing plots from an unapproved layout.

3. On perusal of the sale deed, it is seen that the larger extent of land in Survey No.85/1 was divided into plots and several plots had already been sold prior to 2016. This Court also perused the encumbrance certificate dated 21.05.2025, which has been stated that already Survey No.85/1 was registered in the year 2005. The extent of the property is 2351 square feet. When the said sale deed was registered prior to 2016, the petitioner is entitled to the benefit under Circular dated 16.03.2020 as per clause 7. Therefore, the impugned refusal check slip dated 21.05.2025 is quashed. The respondents are directed to register the sale deed within a period of six (6) weeks from the date of receipt of a copy of this order.

4. With the above said direction, this Writ Petition is allowed. There shall be no order as to costs.
