This Transfer Civil Miscellaneous Petition has been filed seeking transfer of the proceedings in H.M.O.P.No.703 of 2016 from the file of the Family Court, Madurai to the Family Court, Chennai. 1/4

2.The petitioner is the husband and the respondent is the wife. The marriage between the petitioner and the respondent was solemnized on 11.09.2013. Subsequently, due to some difference of opinion, the petitioner/husband filed H.M.O.P.No.703 of 2016, seeking divorce, before the Family Court, Madurai. The grievance of the petitioner is that whenever the petitioner went to Madurai to attend the case, the family members of the respondent threatened him to withdraw the case. Hence, he filed this present Transfer Civil Miscellaneous Petition to transfer the proceedings in H.M.O.P.No.703 of 2016 from the file of the Family Court, Madurai to the Family Court, Chennai. 3.The fact remains that this petitioner/husband only filed H.M.O.P.No.

703 of 2016 before the Family Court, Madurai, for the relief of divorce and now seeking transfer of the above proceedings from the Family Court, Madurai to the Family, Court, Chennai, on the ground that he was threatened by the family members of the respondent wife. If the petitioner is having any apprehension at the hands of the respondent's family members, it is always open to him to lodge a criminal complaint as against them.

4.In view of the above, this Transfer Civil Miscellaneous Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
