ORDER : The Court made the following order :- The petitioner/A2, who was arrested and remanded to judicial custody on 07.05.2025 for the offences under Sections 4(1-A)(ii) and 4(1)(C) of Tamil Nadu Prohibition (Amendment) Act, 2024, in Crime No.38 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 07.05.2025, at about 09.15 hours, based on secret information, the respondent-Police found that the petitioner was in illegal possession of one litre Arrack, 10 litres of fermented water and other accessories for manufacturing liquor. Hence, the case.

3. The learned Counsel appearing for the petitioner submitted that the petitioner is innocent, she was not involved in any offence and she was wrongly implicated in this case.

4. The learned Additional Public Prosecutor appearing for the State submitted that the petitioner has five previous cases, which are similar in nature. She further submitted that the petitioner is a habitual offender. 2/3

5.Taking into consideration of the fact that five cases of this nature are pending against the petitioner and that the petitioner is a habitual offender, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
