O R D E R

The petitioner is a student of Law in National Law School, Trichirappalli. Because of some indiscipline, he was suspended from the College. An F.I.R was registered against him and later, on 27.07.2017, it was closed on the basis of a joint compromise memo filed by the parties in Crl.O.P(MD)No.9731 of 2017. Now that, the petitioner has given an undertaking that he will maintain discipline and will not cause any disturbance to the other students and the Institution. He seeks a direction to permit him to write examinations.

2.The Additional Advocate General would submit that the petitioner may not be eligible to appear for examinations in view of lack of attendance, for, he is under suspension from March 2017.

3. I have considered the rival contentions.

4. Admittedly, the parties have arrived at a compromise and the F.I.R was closed by an order of this Court. The petitioner seeks permission to clear the arrears, which fell during II & IV semesters. In view of his appearance in the examinations on the previous occasions for the same subjects, it cannot be said that there is lack of attendance or that he suffers any disqualification. The petitioner is also willing to undertake by an affidavit, to maintain harmony, discipline and decorum of the Institution.

5. Considering the facts and circumstances of the case, the following directions are given:

(i) The petitioner shall submit an affidavit of undertaking that he will maintain harmony, discipline and decorum while he enters the Institution for writing the examinations and that he will not indulge in any act unbecoming of a student; (ii) The petitioner shall submit the examination fee, penalty and other dues as demanded by the college; and (iii) The respondents, on compliance of the above directions by the petitioner, shall permit him to write examinations for even semesters (II & IV semesters).

6. With the above directions, the Writ Petition is disposed of. No Costs.
