This Writ Petition has been filed seeking a direction to the respondents Nos.1 and 2 to cancel the No Objection Certificate issued in favour of the third respondent in proceedings R.Dis.D2/33816/2021 dated 16.12.2022, by considering the petitioner's representation dated 05.04.2023.

2. It is the case of the petitioner that the fourth respondent had executed forged lease deed in favour of the third respondent in S.Nos. 94/4 and 94/5. Based on the lease deed, the third respondent made an application before the second respondent seeking for permission to set up petrol / diesel storage depot in S.No.94/4A and 94/5A and No Objection Certificate was given to the third respondent. Hence, on 05.04.2023, the petitioner made a representation to the first respondent to cancel the said No Objection Certificate. Since the said representation has not been considered till date, the petitioner has approached this Court. 2/4

3. The learned Special Government Pleader appearing for respondent Nos.1 and 2 would submit that the representation of the petitioner dated 05.04.2023 would be considered in accordance with law.

4. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the second respondent to consider the representation of the petitioner dated 05.04.2023 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order after affording due opportunity of notice to the fourth respondent.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
