Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- For Bail in Crime No. 156 of 2025 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/A14, who was arrested and remanded to judicial custody on 24.04.2025 for the offences under Sections 191(2), 296(b), 115(2), 118(1), 127(2), 140(3) and 351(3) in Crime No.156 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 15.04.2025 afternoon, the petitioner and co-accused persons abducted the deceased Dhilip and Kaluva to coconut grove, 1/3
where the petitioner and co-accused persons indiscriminately attacked them with pipe and other materials and thereby, caused the death of Dhilip and injuries to Kaluva. Hence, the case.
3. The learned Counsel appearing for the petitioner submitted that the petitioner has not joined with the accused persons in any point of time and hence, he did not know anything about the commission of the crime. He further submitted that the petitioner is innocent and he was wrongly implicated in this case.
4. The learned Additional Public Prosecutor appearing for the State submitted that the petitioner / A14 joined with the other accused persons, unlawfully assembled and beaten up the deceased Dhilip to death and caused injuries to Kaluva in a coconut grove. Already, similar application has been moved before the Vacation Sessions Court, Theni and the same was dismissed. 5.Taking into consideration of the seriousness of the offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
