Civil Revision Petition is filed under Article 227 of the Constitution of India, to direct the learned Principal District Judge, Pudukkottai, to dispose of the appeal in A.S.No.1 of 2022 on the ensuing date by pronouncing judgment on 20.07.2023 or within a week thereof without adjourning the pronouncement of judgment on the footing of clarification. ORDER
The Civil Revision Petition is filed by the petitioner/plaintiff for a direction to the learned Principal District Judge, Pudukkottai, to dispose of the appeal in A.S.No.1 of 2022 at an early date. 1/4
2.According to the revision petitioner/plaintiff, he filed a suit in O.S.No.394 of 2012 for declaration and recovery of possession, in which, decree was passed in favour of the petitioner/plaintiff. Against which, the respondent/defendant preferred an appeal in A.S.No.1 of 2022 before the Principal District Court, Pudukkottai, 3.The learned counsel appearing for the petitioner submitted that the revision petitioner is a senior citizen, who is aged about 93 years old. However, the petitioner is unable to see the fruits of the decree during his life time. The learned counsel further submitted that when the appeal has been reserved for judgment on 17.02.2023, it has been adjourned for clarification on 27.02.2023 and for many hearings the appeal was posted for clarification, which caused great hardship to the revision petitioner. Hence, he prays for speedy disposal.
4.On perusal of the records, it is seen that the matter has been reserved for judgment and thereafter, it has been adjourned for clarification on several occasions without any valid reason. 5.Considering the age of the petitioner, this Court directs the Principal District Judge, Pudukkottai, to dispose the appeal in A.S.No.1 of 2/4
2022 on merits and in accordance with law, without giving unnecessary adjournment, as expeditiously as possible preferably, within a period of three weeks from the date of receipt of a copy of this order. 7.With the above direction, this Civil Revision Petition is disposed of. No costs.
