O R D E R

This Writ petition is filed for issuing a Writ of Mandamus, to direct the second respondent to grant permission for conducting 110th year of Devar Jeyanthi Function with used in normal loud speaker on 30.10.2017 at about 06.00 am to 06.00 pm at Seva Nilayam Village, Aundipatti Taluk, Theni District. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3.The petitioner states that he is the District Secretary of All India Farward Block (Vallarasu) Party at Theni District. It is further states that the villagers and youngsters jointly decided to conduct Devar Jeyanthi Function on 30.10.2017 during day time between 06.00 am to 06.00 pm at Seva Nilayam Village, Aundipatti Taluk, Theni District. It is further stated that in this connection, representations were also given to the respondents on https://hcservices.ecourts.gov.in/hcservices/

20.10.2017 and 23.10.2017. However, the respondent police has not yet considered the said representations and hence, the petitioner is before this Court with this Writ Petition. 4.The learned Additional Government Pleader appearing for the respondents, on instructions, submitted that the representation of the petitioner dated 20.10.2017 and 23.10.2017 will be considered in accordance with law.

5.Having regard to facts and circumstances of this Court, without expressing any opinion on the merits of the petitioner's case, this Court is inclined to pass the following direction: 5.1.The second respondent is directed to consider the petitioner's representation dated 20.10.2017 and pass appropriate orders on merits in accordance with law on or before 27.10.2017. 6.With the above directions, the writ petition is disposed of. No costs.
