Writ Petition is Suo Motu initiated under Article 226 of the Constitution of India, as per the News Paper report in "The Hindu" dated today for directing the respondents (I)To clean the channel within a time prescribed by this court, (II)To give proper medication (also providing Nilavembu Kudineer) to the public in order to prevent the disease; and (III)To check on the cleanliness of the public places, periodically. ORDER : This Suo Motu Petition coming on for hearing on this day and upon perusing the above News Paper report and upon hearing the arguments of Mr.M.GOVINDAN, Special Government Pleader for R1 and R2 and Mr.T.S.Mohamed Mohideen, Additional Government Pleader, for R3 and R4, the Court made the following order:- (Order of the Court was made by the Hon'ble Chief Justice) A suo motu public interest litigation is initiated with regard to the dumping of garbage and failure to clean Panaiyur and

Anuppanadi Channels, on the basis of a news report in the Madurai Edition of The Hindu published on Wednesday, October 25, 2017, that is today, under the heading "Residents stifled between channels" 2.The pictures published are distressing. The dumping of garbage on roads and channels and failure to cleanse market areas pose a health hazard. This Court cannot but take judicial notice of several reports of incidents of dengue and even death on account of dengue as also other mosquito borne diseases. Dumping of garbage in the channels, roads and other places causes other diseases as well. 3.The Madurai Corporation shall immediately take steps to have the channels cleaned and submit a report on 27.10.2017 at 10.30 A.M. The District Administration shall render cooperation and take necessary steps, if required, for implementation of this order. 4.The State and the Madurai Corporation be impleaded as parties. The State and the Madurai Corporation may be served through the learned Government Pleader.
