Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the punishment order passed on the petitioner dated 22.06.2009 and First Appellate Authority order dated 12.11.2009 and Second Appellate Authority order passed on the petitioner dated 19.04.2010 and quash the same and consequently direct the respondents 1 to 3 to pay the arrears amounts to the petitioner which the petitioner legally entitled and consider the petitioner's promotion since 2005 within the specific period.

O R D E R

The learned counsel for the petitioner seeks to withdraw the Writ Petition as neither any part of cause of action has arisen nor any of the respondents are having their office, within the territorial limits of jurisdiction of the Madurai Bench of Madras High Court as held by the Full Bench of this Court in the case of B.Stalin Vs. The Registrar, Supreme Court of India, reported in 2012 (4) CTC 113.

2.Recording the same, this Writ Petition is dismissed as withdrawn with liberty to the petitioner to pursue the legal remedies before the competent forum with territorial jurisdiction in accordance with law. No costs. Consequently, the connected miscellaneous petition is closed.
