ORDER

Heard Mr.Karuppusamy for Mr.V.Sanjeeivi and Mr.G.Surya Anand, learned Additional Government Pleader, for the respondent.

2. When the writ petition was taken up, Mr.Karuppasamy, invited my attention to the order passed by the Division Bench of this Court in M/s.Sakthi Mining Company /vs/ The Secretary to the Government Industries Department and three others in Writ Appeal No. 671 of 2020, etc. batch, dated 15.02.2024 and pointed out that the Division Bench had quashed the impugned orders, similar to the one in the present writ petition and had remitted the matter to the District Collector to pass fresh orders after hearing the petitioner.

3. Mr. Surya Anand, states that pursuant to the order of the Division Bench, the District Collector, Pudukottai District had issued fresh notice to the petitioner and heard him and passed an order imposing a penalty of Rs. 1,35,37,174/-. This order was passed on 15.07.2024 after hearing the writ petitioner.

4. Since the 3rd respondent has complied with the order of the Division Bench, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. Liberty is granted to the petitioner to challenge the order imposing the penalty in the manner known to law. 07.04.2025 mrp To
