PRAYER: Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Mandamus to direct the third respondent to give police protection to measure and fencing of the petitioner's property with regard to Palayam Village Survey No.56 /2 to an extent of 76 cents and Survey No.56/24 to an extent of 1 Acre and 54 cents situated at Vedasandur Taluk, Dindigul District based on the petitioner's representation dated 16.08.2018.

This petition has been filed for a direction to the third respondent Police to give Police protection to enable the Tahsildar to survey and measure the property. 2.It is the case of the petitioner that he is the owner of the property in Survey Nos.56/2 and 56/24 by virtue of a sale deed dated 29.12.1994. Since, there was a dispute with regard to the extent to the property, the petitioner made a representation to the first respondent to measure the property. The first respondent came to the land of the petitioner and was conducting https://hcservices.ecourts.gov.in/hcservices/
survey, but the 4th respondent restrained him and prevented him from conducting survey.
3.In view of the same, the petitioner gave a representation dated 16.08.2018 to the respondent Police to give Police protection for the purpose of surveying the property with the help of the first respondent. Subsequently, the petitioner made representation to the first respondent dated 26.06.2018 requesting him to survey the property and he has also paid appropriate charges on the very same day for the purpose of conducting survey.
4.In the facts and circumstances of the case, there shall be a direction to the third respondent Police to give sufficient Police protection to the first respondent to carry out survey in the property belonging to the petitioner and to place boundary stones.
