Respondent PRAYER : Writ Petition filed under Article 226 of the Constitution of India prayed to issue Writ of Mandamus directing the respondent to disposal of my pending Advocate fees application dated 20.09.2017 before the Managing Director of TASMAC Ltd, Chennai to give Rs.87,31,000/- on the basis of petitioner's representation and therefore with time frame that may be fixed by this Court. For Petitioner : Mr.M.Muniasamy (Party-in-person) For Respondent : Mr.H.Arumugam Standing Counsel for TASMAC.

ORDER

The Writ Petitioner was the Standing Counsel and Legal Advisor for TASMAC, for quite a few years in the Madurai Bench of Madras High Court.

2. The grievance of the petitioner is that the respondent had not settled his fee bills. According to him, the fee arrears is to the tune of Rs.87,31,000/-. The petitioner gave a representation on 20.09.2017 to the respondent. Of course, if the client does not pay the fees to his lawyers, the Writ Petition cannot normally be maintained for recovering the fee arrears. But in this case, the client of the Writ Petitioner happens to be a State Government undertakings. Therefore the respondent is directed to compute the fee payable to the Writ Petitioner and settle the same within a period of eight weeks from the date of receipt of a copy of this order.

3. If the Writ Petitioner has any dispute regarding the fee calculation, it is open to the Writ Petitioner to accept the amount quantified by the respondent without prejudice to his contentions and rights.

4.With the above direction, this Writ Petition stands allowed. No costs.
