MANDAMUS calling for the records relating to the impugned return order of the 1st respondent in Proceedings impugned order in Ref. No. 1438/I1/2026 dated 17.04.2026, quash the same as illegal and consequently direct the 1st respondent to accept the change among the members of the committee and Form-7 submitted by the petitioners society, within time frame fixed by this Court. ORDER
The petitioner challenges the order dated 17.04.2026 issued by the first respondent whereby the petitioner had been called upon the sanctioned additional relevant documents to consider the Form-VII submitted by the petitioner.
2. The petitioner had approached this Court earlier in W.P(MD)No. 8006 of 2026. This Court, vide order dated 25.03.2026, preserved liberty to the petitioner to resubmit Form-VII along with the proceedings of the General Body meeting and other other relevant documents and upon such 2/6
submission, the first respondent was directed to consider the same on its own merits and pass appropriate orders in accordance with law. Pursuant to the order passed by this Court, the petitioner claims to have submitted all the relevant documents for acceptance of the Form-VII. The first respondent has issued the impugned order calling upon the petitioner to furnish additional relevant documents to consider the claim of the petitioner. The petitioner states that all the relevant documents have been furnished for considering his claim and therefore, the first respondent ought not to have issued the order calling upon the petitioner to furnish the additional relevant documents. The said order does not disclose the additional relevant documents to be produced by the petitioner.
3. Therefore, the first respondent is obligated to consider the claim of the petitioner on the available documents produced by the petitioner. Accordingly, the Writ Petition is disposed of directing the first respondent to consider the claim of the petitioner for acceptance of Form-VII on the available documents on record in accordance with law and pass an appropriate order within a period of six weeks from the date of receipt of a copy of this order.

4. The first respondent shall also consider the principles laid down by the Full Bench of this Court in the case of C.M.S.Evangelical Suvi David and Other v. The District Registrar and others reported in 2005 Supreme(Mad) 535:2005 2 MLJ 335, before passing any appropriate order.
5. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
