Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India prayed to issue a Writ of Mandamus, directing the first and second respondents to conduct the enquiry and dispose the complaint made by the petitioner dated 17.02.2017 in respect of cancellation of Christ Church Society registration, which is registered under the Tamil Nadu Societies Registration Act, 1975 in registration No.135/2016, dated 05.12.2016 within the stipulated time fixed by this Court.

ORDER

The petitioner submits that the Christ Church (CSI) was established in the year 1929. It has more than 1500 members. It is affiliated to the Church of South India (CSI), Madurai - Ramnad Diocese. The petitioner has been functioning ever since. https://hcservices.ecourts.gov.in/hcservices/

While so, it is alleged that the third respondent had formed another society with a similar sounding name. This has given rise to confusion in the administration of the Church. Therefore, the petitioner has given complaint dated 17.10.2017 in this regard.

2. The grievance of the petitioner is that though the second respondent received the said complaint, he had not taken any action thereon. Therefore, this petition has been filed.

3. This Court directs the second respondent to dispose of the writ petitioner's complaint dated 17.02.2017 in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

It is made clear that the second respondent must give notice to the interested and affected parties, hold appropriate enquiry and thereafter pass final orders. It is also clarified that this Court has not expressed any opinion on the merits of the matter.

4. This Writ Petition is accordingly, disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
