Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 4th respondent to consider the representation of the petitioner dated 19.09.2016 and to give computer chitta and patta on the basis of earlier order passed by the 4th respondent dated 16.04.2001. ORDER

By consent, this writ petition itself is taken up for final disposal.

2.Mr.M.Alagathevan, learned Special Government Pleader takes notice for the respondents.

3.According to the petitioner, the property in Survey No.331/2 in Kallakudi-2, Lalgudi Taluk, Trichy District belongs to him and there is neither civil suit nor rival claim whatsoever pending in respect of the property in question and as such, he is enjoying possession over the same. Whereas, in the revenue records, in respect of the subject mentioned property, names of some third https://hcservices.ecourts.gov.in/hcservices/

parties were mentioned and aggrieved thereby, the petitioner has preferred a representation and after some rounds of litigation, the fourth respondent has passed an order dated 16.04.2001, sub-dividing the survey number of the aforesaid property. Though this order of the fourth respondent was passed as early as on 16.04.2001, the same was not entered in the patta, chitta and adangal. Therefore, the petitioner has submitted a representation dated 19.09.2016, seeking patta in his name, in respect of the aforesaid property and as the same is kept pending, without any action, the petitioner is before this Court.

4.The learned counsel for the petitioner would submit that it would be suffice, if the representation of the petitioner dated 19.09.2016, is disposed of, by the respondents, as per law, within a stipulated time limit.

5.Considering the limited scope of the relief sought for, this Court, without going into the merits of the petitioner's claim, directs the second respondent to consider the representation of the petitioner dated 19.09.2016 and pass appropriate orders on its own merit and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the interested parties, if any, within a period of six weeks from the date of receipt of a copy of this order.
