ORDER
This Writ Petition has been filed by the petitioner for a direction directing the second respondent to pay compensation of Rs.5,00,000/- to the petitioner for the injuries sustained by her due to electrification.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.The petitioner while working as a saleswoman in a ration shop at Kelaiyapillaiyur Village, Ambasamuthiram Taluk, Tirunelveli District, on 25.04.2019 there was a high tension electric wire (11 KV) was hanging over the ration shop and fell down on the petitioner. Due to which, she got electrocuted and suffered disfiguration of her face and also lost her right side eyesight and hearing capacity of her right ear. Immediately, she was admitted into the Government Headquarters Hospital, Tirunelveli on 25.04.2019 and admitted as an inpatient till 15.05.2019. Thereafter, she had taken treatment at Thanvanthri Hospital for her mental 2/6
trauma. Though the petitioner lodged a complaint before the Inspector of Police, Kadam Police Station, Tirunelveli, she was issued CSR in C.S.R.No.370 of 2019 and no F.I.R has been registered so far. The said accident was informed to the second respondent and on inspection, the second respondent submitted a report dated 25.04.2019 to the higher officials. From the said report, it is evident that the petitioner sustained grievous injuries due to a sudden fall of high tension electric wire on 25.04.2019. Now the petitioner suffered disability for 100% and she was also removed from service.
4.As per the Tamil Nadu Power Distribution Corporation Limited Proceedings No.11, dated 21.12.2024 under the head of non-fatal for the loss of two limbs or two eyes entitled for compensation to the tune of Rs.3,00,000/-. In view of the above, the petitioner is entitled for compensation under the Tamil Nadu Power Distribution Corporation Limited Proceedings No.11, dated 21.12.2024. The Chief Engineer, TANGEDCO, Tirunelveli District is directed to disburse the compensation of Rs.3,00,000/- to the petitioner as compensation as per the Tamil Nadu Power Distribution Corporation Limited Proceedings No.11, dated 21.12.2024, within a 3/6
period of two weeks from the date of receipt of a copy of this order. Further, the petitioner is at liberty to file a claim petition before the competent forum seeking compensation for the injuries sustained by her in the manner known to law. There shall be no order as to costs.
