ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 128(2), 296(b), 115(2), 324(2) and 351(3) of Bharatiya Nyaya Sanhita, 2023 and Section 4 of TNPWH Act in Crime No. 71 of 2026 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners and the defacto complainant are living in same locality. On 24.04.2026 at about 7.00 p.m., the petitioners abused the defacto complainant with filthy language and attacked him with hands causing simple injuries. Hence, the case.

They have not committed any offence as alleged by the prosecution. Hence, he prayed to grant anticipatory bail to the petitioners. 2/6

4. The learned Government Advocate (Crl. Side) would submit that based on the complaint given by the defacto complainant, a case has been registered for the offences punishable under Sections 128(2), 296(b), 115(2), 324(2) and 351(3) of Bharatiya Nyaya Sanhita, 2023 and Section 4 of TNPWH Act in Crime No. 71 of 2026. Considering the rival submissions made on either side and the nature of offences charged against the petitioners, and considering the facts that the parties are living in same locality and injured was discharged from the hospital and the petitioners have no previous case, I am inclined to grant anticipatory bail to the petitioners, subject to the following conditions:

3/6
