PRAYER :- For Bail in Crime No.159/2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 07.06.2022 for the alleged offence under Sections 394 IPC, in Crime No.159 of 2022, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 06.06.2022 when the defacto complainant was returning to his house at about 09.05 P.M., the accused persons assaulted the defacto complainant and snatched his mobile phone worth about Rs.20,000/-, cash Rs/500/- from his pocket. During the occurrence, the accused persons pushed him down and he sustained injuries. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Ever since from the date of arrest, ie., 07.06.2022, the petitioner is in custody and he has no previous cases pending at his credit.
4.The learned Government Advocate (Crl.Side) submitted that there is no previous case against the petitioner. The investigation has not been completed.

CRL OP(MD). No.12530 of 2022 5.Perusal of records it appears that the stolen articles were recovered from the co-accused viz., Arunkumar. Considering the above and the period of incarceration and also the fact that the petitioner is not having any previous case, this Court is inclined to grant bail to the petitioner with stringent conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Bodinayakanur, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
