ORDER : The Court made the following order :- The petitioner/accused (rank not known), who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 288 of BNS, 2023 r/w Section 9(B)(1)(b) of Indian Explosives Act, 1884 and Section 194 of BNSS, 2023 in Crime No.107/ 2025, seeks anticipatory bail.

2. The case of the prosecution is that on 18.05.2025, at about 9.40 a.m., while handling explosives in a building owned by the petitioner, a sudden accident happened and two persons died on the spot. It was found that the accused persons illegally purchased explosives and kept in the unused cell phone tower building without safety, which resulted in accident. Hence, the complaint.

3. The learned counsel appearing for the petitioner submits that one Mohamed Riyas was manufacturing crackers with the explosives supplied by Sundarraj. Due to rain, they kept the explosives in the unused land of the petitioner. He further submits that petitioner is an innocent person and without prior permission, the deceased persons used the petitioner's land to keep the explosives. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that the petitioner is having twelve previous cases in similar nature and investigation is pending. Hence, she strongly objected for grant of anticipatory bail to the petitioner.

Considering the nature and gravity of the allegations levelled as against the petitioner and that two persons died in the said accident and also considering the fact that the investigation in this case is not yet completed, this Court is not inclined to grant anticipatory bail to the petitioner.
