For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.575 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 323, 427 and 294(b) I.P.C and Section 4 of Tamil Nadu Prohibition of Harassment of Woman Act, in Crime No.575 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defacto complainant are neighbours. Due to the dispute regarding the coconut tree shedding in the common wall, the petitioner and other accused assaulted the defacto complainant and caused injuries. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution, but he has been falsely implicated in this case.

CRL OP(MD)No.12041 of 2021 4.The learned Government Advocate (Criminal side) strongly opposed for grant of anticipatory bail on the ground that apart from this case, the petitioner has involved in twelve previous cases. He would further submit that the investigation in this case is yet to be completed.

5.Considering the nature of allegation levelled as against this petitioner and also considering the previous antecedents, this Court is not inclined to grant anticipatory bail to the petitioner.
