ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 310(2) of BNS, 2023 in Crime No.185 of 2025 on the file of the respondent police, seeks anticipatory bail. 1/4
2. The case of the prosecution is that the de-facto complainant and his friends are third-year students at Sri Adisankarar Polytechnic College. On 17.05.2025, at about 9.00 p.m., the accused persons went to the hostel of the said college, threatened the de-facto complainant and his friends, and took away their mobile phone, ATM card, and cash. Hence, a case has been registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. The petitioner is a college student, studying second year of B.Sc. Computer Science at SRM Trichy Arts and Science College, Trichy. He has been arrayed as an accused in this case solely based on the confession of the co-accused. He further submitted that A1, A2, A3 and A7 were arrested and subsequently released on bail by the learned Principal District and Sessions Judge, Tiruchirappalli on 05.06.2025 in Cr.M.P.Nos.293, 320 and 323 of 2025, respectively. He, however, submitted that the petitioner is willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail.
4. The learned Government Advocate (Criminal Side) submits that the petitioner has been arrayed as A10 in this case. A1, A2, A3 and A7 were arrested and subsequently released on bail by the learned Principal District and Sessions Judge, Tiruchirappalli on 05.06.2025 in Cr.M.P.Nos.293, 320 and 323 of 2025, 2/4
respectively. He further submitted that out of the 13 cell phones that were stolen, only 9 have been recovered till date, and the remaining properties are yet to be recovered. Hence, he strongly opposed to grant anticipatory bail to the petitioner.
5. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence, and also taking note of the fact that some of the properties have not yet been recovered, and that the investigation is at a crucial stage, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
