PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondents to complete the enquiry proceedings initiated in O.Mu.A5/5543/2020 dated 15.12.2020 and in O.Mu.A5/3537/2021 dated 28.09.2021 and cancel the Patta No.293 issued in the name of one Kannammal W/o.Arumugam, by the 3rd respondent for the petitioner's family property of bearing Survey No.680, with an extent of 3 Acres and 11 Cents, situated at Aniyappur Revenue Village, Manapparai Taluk, Tiruchirappalli District, and issue Patta in the petitioner's family name. The Writ petition has been filed in the nature of a Mandamus seeking a direction to the second respondent/Revenue Divisional Officer, Vannankoil, Srirangam, Trichy District, to dispose of the application given by the petitioner which is pending before the said official.

2. The learned Special Government Pleader had forwarded, written instructions given by the third respondent/ Tahsildar, Manapparai, wherein, it had been stated that enquiry had been conducted and since there is disputed question of law on facts involved relating to holding of the land, it would only be advisable that the parties approach the civil Court.

3. Let the second respondent pass necessary orders so that the petitioner can take it up further in manner known to law. The second respondent may dispose of the application pending before him, after following due process on or before 31.07.2023.

4. With the above directions, the Writ Petition stands disposed of. No costs.
