PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 & 2 to forthwith disburse the petitioner's increments benefits and other benefits along with interest, by considering the petitioner's representation dated 10.02.2020, 25.02.2021 and 10.03.2023 within the time limit. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner filed this writ petition seeking a direction to the respondents 1 & 2 to forthwith disburse the petitioner's increments benefits and other benefits along with interest, by considering the petitioner's representation dated 10.02.2020, 25.02.2021 and 10.03.2023 within the time limit.

2. The petitioner was appointed as Typist through the Tamil Nadu Public Service Commission on 08.08.2012. During the audit conducted for the year 2017-2018, an audit objection was raised by the office of the Accountant General based on Government Letter No. 16115/CMPC/2018-1 dated 25.08.2018. In the said objection, it was stated that the incentive increment for acquiring a degree was not admissible to the petitioner on the ground that she had joined Government Service prior to 08.08.2012. Hence, the petitioner has made representations dated 10.02.2020, 25.02.2021 and 10.03.2023 before the authorities concerned seeking to disburse the increment benefits. Since the same was not considered, the petitioner has filed the present writ petition.

3.The learned counsel appearing for the respondents submitted that the petitioner's representation would be considered and appropriate orders would be passed on merits and in accordance with law within the time stipulated by this Court.

4.In view of the above, this Court, without going into the merits of the claim made by the petitioner, directs the authorities concerned to consider the petitioner's representations dated 10.02.2020, 25.02.2021 and 10.03.2023 respectively and pass appropriate orders on merits and in accordance with law. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

5.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
