Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the first respondent to reconsider the transfer of the petitioner to the Sub-Jail, Ariyalur in the Proc.No.6459/E.S. 3/2024 dated 24.05.2025 of the first respondent and to post the petitioner at any of the Prison/Jail nearby to Tirunelveli i.e at Sub Jail, Tenkasi or Sub Jail,
Tiruchendur or District Prison, Nagercoil considering the petitioner's representation dated 25.05.2025 within a time limit to be fixed by this Court. For Petitioner : Mr.B.Karunanithi For Respondents : Mr.S.R.A.Ramachandran Additional Government Pleader
ORDER
By consent of both sides, this Writ Petition is taken up for disposal at the stage of admission itself.
2. This Writ Petition is filed seeking to direct the first respondent to reconsider the transfer of the petitioner to the Sub-Jail, Ariyalur in the Proc.No.6459/E.S.3/2024 dated 24.05.2025 of the first respondent and to post the petitioner at any Prison/Jail nearby Tirunelveli by considering the petitioner's representation dated 25.05.2025.
3. Mr.S.R.A.Ramachandran, learned Additional Government Pleader, takes notice for the respondents. He submitted that already, the relieving order has been served on the petitioner through Whatsapp.
4. The learned counsel for the petitioner submitted that the petitioner's transfer should be reconsidered on medical grounds and due to the education of his female children, for whom, the petitioner had already remitted fees for the VIII and X standards respectively.
5. Considering the genuinity of the plight of the petitioner, this Court hereby direct the respondents to consider the petitioner's representation dated 25.05.2025 and pass appropriate orders in accordance with law within a period of two (2) weeks from the date of receipt of a copy of this order. Till a final decision is taken on his representation, let the petitioner not be disturbed.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
