PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records of the third respondent dated 06.06.2023 calling the petitioner for an enquiry at the instance of the second respondent, quash the same as the same is arbitrary, ultravires, in excess of powers, in abuse of powers. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the official respondents has submitted that the enquiry in respect of a summon issued dated 06.06.2023 asking the petitioners to appear on 10.06.2023 is already over and the representation is closed, thereby, the presence of the petitioners is not required in the enquiry and the same is recorded.

2. Since this petition is filed questioning the issuance of very summon dated 06.06.2023 and the proceedings itself are closed and the learned Additional Public Prosecutor appearing for the respondents 1 to 2/5

3 submits that the presence of the petitioners are not required, the cause does not arise in this writ petition.

4. Accordingly, this Writ Petition is closed. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
