ORDER : The Court made the following order :- The petitioner/Accused (rank not known), who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A) 1/3

and 4(1)(C) of Tamil Nadu Prohibition Act (Amendment) Act, 2024 in Crime No.505 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant, who is working as a Sub-Inspector of Police, while on patrol, found that the accused was in illegal possession of 66 bottles of brandy, each containing 180 ml. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the above said offence. There is no recovery from the petitioner. He also submitted that the petitioner is having permanent resident at Madurai District and he is not having any bad antecedents. Hence, he prayed that this petition be allowed.

The learned Government Advocate (Criminal Side) for the respondent police strongly objected to the submissions made by the learned counsel for the petitioner and submitted that the petitioner, being the sole accused, was found in illegal possession of liquor bottles. He allegedly sold bottles of brandy and rum, each with a selling price of Rs. 500/-. The petitioner was in possession of 66 bottles, which were illegally transported with the intent to sell them for substantial profit. He further submitted that the investigation is still pending. Hence, he prayed that this petition be dismissed.

Considering the nature and gravity of the allegations levelled as against the petitioner and also considering the fact that the investigation in this case is not yet completed, this Court is not inclined to grant anticipatory bail to the petitioner.
