ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 406, 420, 468, 471, 365, 342, 323, 506(ii) of IPC, in Crime No.10 of 2025 on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that, due to a land dispute between the parties, on 11.01.2025, the petitioners and others trespassed into the house of the defacto complainant, kidnapped him, took him to a building, and obtained his signature on stamp papers for realizing an amount. Thereafter, they left the defacto complainant at his house. Hence, a case has been registered against the petitioners.

3. The learned counsel appearing for the petitioner submitted that initially the petitioner had preferred a complaint before the Ponparrapi Police Station, which was enquired and closed. Subsequently, he preferred a complaint before the Superintendent of Police, Karur District, 2/5

and after enquiry, the same was also closed. Thereafter, a petition under Section 151(3) of the Cr.P.C. was filed before the Judicial Magistrate Court-II, Karur, based on which the present First Information Report was registered. He seeks this Court to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that money dispute is pending between the parties.

Considering the fact that a money dispute is pending between the parties and also considering the allegations, interim anticipatory bail was granted to the petitioners and the matter was referred to the Mediation Centre for settlement. However, the mediation failed. Hence, the interim order already granted by this Court is made absolute and confirmed, and this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions. 3/5

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioners shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court-I, Karur, Karur District, within a period of fifteen days from the date on which the order copy is made ready and on further conditions that:

[a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b] the petitioners shall report before the respondent police as and when required for interrogation.

[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial.

[d] the petitioners shall not abscond either during investigation or trial.

[e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the 4/5

petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
