ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 323, 324, 506(ii) of IPC and Section 4 of Tamil Nadu Prohibition of harassment of Woman Act, 2002 in Crime No.368 of 2021, seek anticipatory bail.

2.The case of the prosecution is that on 16.08.2021, the accused tried to build a ramp in front of the house of the defacto complainant which would cause hardship to the general public to use the road. Hence the defacto complainant tried to stall the same. At that time, the accused persons attacked him. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. The learned counsel for the petitioners submitted that the petitioners are innocents and they have been falsely implicated in this case. He further submitted that the above said ramp would not be in any way hindrance to the public to use the road and due to previous enmity, the defacto complainant has given a false complaint against the petitioners.

4. Heard the learned Additional Public Prosecutor appearing for the respondent Police.

5. Considering the conduct of the petitioners in encroaching upon the public road and that when it was objected to by the defacto complainant, they attacked him, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition stands dismissed.
