O R D E R

This petition has been filed seeking quashment of proceedings in M.C.No.07 of 2021 on the file of the learned Judicial Magistrate, Bodinayakkanur, Theni District.

2.Even though the petition has been filed for the relief of quashment of MC, the learned counsel for the petitioner at the time hearing would submit that he restricts his relief only with regard to dispensing the personal appearance of the petitioner before the trial Court, since he is working as a P.G. Assistant in ZKM Higher Secondary School, Bodinayakanur.

3.Since the petitioner is working as a teacher, his personal appearance before the trial Court is dispensed with on the following conditions.

(i)The petitioner shall appear before the trial Court namely the Judicial Magistrate Court, Bodinayakanur, within a period of 15 days from the date of receipt of a copy of this order and file an undertaking affidavit, by affixing his recent passport size photograph, to the effect that he will appear before the trial Court as and when required and must ensure his proper representation through Advocate.

CRL OP (MD) No.12087 of 2021 4.With the above direction, this criminal original petition is disposed of. Consequently, connected miscellaneous petitions are closed.
