Respondents PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to take action against 5th to 15th respondents, remove the illegal encroachment done by them, by encroaching the public property comprised in Survey No.48/2, including the so-called sub-divisions 48/2A, 48/2B and 48/2C, situated at Thondi Village, Thiruvadanai Taluk, Ramanathapuram District to an extent of 30 Ares, forthwith petitioner's representation cum complaint dated on 30.01.2026 by ensuring the public utility, safety.

(Order of the Court was made by N.SATHISH KUMAR, J.) The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 4 to take action against 5th to 15th respondents, remove the illegal encroachment made by them, by encroaching the public property comprised in Survey No.48/2, including the so-called sub-divisions 48/2A, 2/5
48/2B and 48/2C, situated at Thondi Village, Thiruvadanai Taluk, Ramanathapuram District to an extent of 30 Ares, forthwith considering the petitioner's representation cum complaint dated on 30.01.2026 by ensuring the public utility and safety.

Learned counsel for Government of Tamilnadu would submit that the official respondents will conduct survey and if there is any encroachment in the public property located in the abovesaid survey numbers as alleged by the petitioner, the same will be removed by due process of law within a time frame. 3.
Recording the said submission, the official respondents are directed to conduct survey and ascertain as to whether there is any encroachment in Survey No.48/2, including the so-called sub-divisions 48/2A, 48/2B and 48/2C, situated at Thondi Village, Thiruvadanai Taluk, Ramanathapuram District to an extent of 30 Ares, by the private respondents herein as alleged by the petitioner. If so, such encroachment shall be removed by due process of law after affording opportunity to the private respondents and all other parties concerned. Such an exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
