For Anticipatory Bail in Crime No.185 of 2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 331, 305(a) of BNS, in Crime No.185 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 16.09.2025, the petitioner along with other accused stolen the property of the defacto complainant at the garden. Hence, the case has been registered.

3. The learned counsel for the petitioners submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that, as per the confession of the co-accused, the petitioner has been falsely implicated in this case. Hence, he seeks anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) submitted that the 2/4

petitioner is herein arrayed as Accused No.2 and is having one previous case. He would further submit that Accused No.1 has already been arrested and released on bail and Accused No.3 is still in custody, and the property has not been recovered sofar. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and also taking note of the fact that the petitioner is having one previous case and that the property has not been recovered sofar, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
