ORDER

This Criminal Original Petition has been filed for issuing direction to the 1st respondent to transfer the petitioner's complaint in CSR.No.291 of 2023, dated 31.05.2023 on the file of the 3rd respondent to any other officer subordinate to the 1st respondent.

2. It is a simple issue between the practising Advocate and driver of the Transport Corporation.

3. The learned Additional Public Prosecutor would submit that it is case of case and counter. In respect of the complaint given by the petitioner, he has not appeared before the second respondent police, whereas the counter party appeared and made a statement that he will not make any trouble to the petitioner in future.

4. In respect of the complaint given by the petitioner stating 2/5

that his car has been damaged by the counter party, let him appear before the 2nd respondent. Let the 2nd respondent complete the enquiry within a period of 15 days from the date of appearance of the parties. Depending upon the outcome of enquiry, the petitioner is directed to work out his remedy through appropriate proceedings. On that ground transfer of investigation is not necessary.

5. With the above direction, this Criminal Original Petition is disposed of.
