PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the fourth respondent College, namely, S.T. Hindu College, Nagercoil, Kanyakumari District to promote the petitioner as the Principal of College as per Rule 11(4) of The Tamil Nadu Private Colleges (Regulation) Rules, 1976.

ORDER

By consent of both sides, this Writ Petition is taken up for disposal at the stage of admission itself.

2. This Writ Petition is filed seeking to direct the fourth respondent College, namely, S.T. Hindu College, Nagercoil, Kanyakumari District to promote the petitioner as the Principal of College as per Rule 11(4) of the Tamil Nadu Private Colleges (Regulation) Rules, 1976.

3. Mr.P.Thambidurai, learned Government Advocate, takes notice for the respondents 1 and 2. Mr.Mahaboob Athiff, learned Standing Counsel, takes notice for the third respondent. Mr.V.Panneer Selvam, learned counsel, takes notice for the fourth respondent.

4. The anticipation of the learned counsel for the petitioner is that the fourth respondent College may negate the petitioner's seniority and consider the candidates, who are juniors than him, to the post of Principal.

5. The petitioner had already made a representation to the respondents on 22.05.2025 and had also made an application for the post of Principal on 19.03.2025. In view of the same, this Court hereby directs the fourth respondent to consider the petitioner's application dated 19.03.2025 and consider the case of the petitioner for being appointed as Principal in terms of the Tamil Nadu Private Colleges (Regulation) Rules, 1976 and pass appropriate orders in accordance with law within a period of one (1) week from the date of receipt of a copy of this order. Till such time, let the fourth respondent College not appoint any other person to the post of Principal.

6. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
