ORDER
Heard the learned counsel for the petitioner and M/s.K.Porkodi, learned Counsel for Government for the respondents.
2. The case of the petitioner is that while he was working as Assistant Engineer in the respondent Board, he was implicated in a criminal case and as well as in the departmental proceedings. According to the learned counsel for the petitioner, the case of the petitioner was not considered for promotion to the post of Assistant Executive Engineer on par with his juniors because of his involvement in the criminal case and pendency of disciplinary proceedings. However, the criminal case ended in acquittal in the year 2023 and the departmental proceedings are also quashed by this Court in WP(MD)No. 25485 of 2025 dated 23.01.2026. 2/5

In the light of the above, the petitioner claims to have submitted a representation dated 18.04.2026 for considering his case for notional promotion on par with his juniors from the post of Assistant Engineer to the post of Assistant Executive Engineer. However, the said representation is still pending and the petitioner is due for attaining superannuation within a period of one year. Hence, the petitioner approached this Court seeking appropriate direction for consideration of his claim for notional promotion by duly considering the representation dated 18.04.2026.
4. The learned Counsel for Government appearing for the respondents fairly submitted that the respondents would consider the representation on its own merits expeditiously.
5. In the light of the above, without going into merits of the matter, this writ petition is disposed of directing the first respondent to consider the representation dated 18.04.2026 submitted by the petitioner claiming notional promotion from the post of Assistant Engineer to the post of Assistant Executive Engineer and pass appropriate orders as 3/5
