Respondents Petition filed under Article 226 Constitution of India to issue a Writ of Mandamus forbearing the third respondent from interfering with the execution of the work allotted to the petitioner in proceedings dated 14.07.2017 in respect of Karuppukal kanmoi, Karuppukal village under the jurisdiction of the second respondent without any valid reason.

ORDER

This writ petition has been filed on the ground that the petitioner was granted with a contract to renovate the Karuppukal kanmoi by the first respondent, District Collector. When the petitioner commenced the work, the third respondent/Executive https://hcservices.ecourts.gov.in/hcservices/

Engineer, PWD, prevented the petitioner from executing the work, on the ground that the tank belongs to the third respondent. Hence, this writ petition has been filed.

2.Earlier, notice was ordered to the respondents. Today, when the matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1, 3 and 4 submitted that the dispute between the petitioner and third respondent is resolved and a No Objection Certificate has been granted to the petitioner to execute the work. He has also produced a copy of the order dated 26.03.2018 to that effect. 3.In the above circumstances, since the petitioner is permitted to execute the work, nothing survives in this petition for further adjudication.
