PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, calling for the records pertaining to the impugned of suspension issued by the respondent in his proceedings in HR/06/3058, dated 11.10.2023 and subsequent charge sheet, issued by the respondent dated 18.10.2023 and quash the same as illegal and consequently directing the respondent to reinstate the petitioner into service with back wages within a time stipulated by this Court.

ORDER

The instant writ petition has been filed by a Semi-skilled employee of the respondent company, challenging his order of suspension and charge memo. 2.The learned Counsel appearing for the respondent company has brought to the notice of the Court that pending writ petition, the petitioner has been dismissed from service on 25.06.2024. The petitioner had challenged the said order in W.P(MD)No.15382 of 2024. This Court by an order dated 11.07.2024 has allowed the writ petition. Challenging the same, the Management had filed W.A.(MD)No.1712 of 2024 and an order of impugned stay has been granted by the Hon'ble Division Bench on 25.09.2024.

3.In view of the above said subsequent events, the question of considering the order of suspension and the charge memo on merits by this Court does not arise.

4.Accordingly, this writ petition stands closed. No costs. Consequently, connected miscellaneous petitions are also closed. 04.11.2024 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
